Terms & Conditions – Towbar fitting

  1. Agreement and Contract Creation

When making an enquiry for a mobile towbar fitting appointment either via email, our website or telephone you will be given a quote for the services, or to have goods fitted by Ultimate Towbars, this constitutes an “offer”.

If you chose to proceed with a fitting appointment we will take your full fitting details, this does not constitute the “acceptance” until the full payment has been taken and you have received a separate email “booking confirmation”, this will be sent once all parts have been ordered.

If for any reason we are unable to source the correct parts for your booking, Ultimate Towbars will not be liable to you except to issue a full refund.

Under no circumstances should you arrange to use your towbar until after the towbar has been fully fitted and you have tested the towbar and all electrics with your trailer, bike carrier or caravan. Ultimate Towbars will not be liable for any missed holidays or costs incurred for any arrangements made by you before your towbar has been fitted and tested.

It is your responsibility to ensure your vehicle is suitable for towing and that the vehicle has the correct towing capacity for your intended use.

These terms are the only terms upon which Ultimate Towbars will contract with you for purchase of its services.

Ultimate Towbars retains the right to refuse service to anyone without further explanation at our discretion. If it appears you are attempting to place an order dishonestly, fraudulently or by using stolen card details, we will undertake additional checks and where appropriate report to the relevant external authorities.

 

  1. Mobile Bookings

Fitting appointments are offered on an AM or PM basis, with an arrival time of 9am-12pm and 12pm-5pm. This is an estimated arrival time and not when your fitting will be completed. We will try our best to ensure the technicians arrive within the given time frame however the times given are not a contractual term. We will inform you as soon as reasonably possible of any delays.

All fittings must be completed on a private driveway or car park, we cannot complete any fittings where it is not safe for our technicians. Our technicians will require adequate room to work on your vehicle with close access to their vehicle to use the tools required etc. We cannot complete a fitting on any public highway or by parking the technicians vehicle on double yellow lines, the cost of any additional parking fees or permits will need to be covered by you.

Photos will be taken of your vehicle, to record any existing visible damage before commencing work on your vehicle. We exclude all liability for repair of damage, whether visible or not, existing prior to working on your vehicle. This includes the exhaust on your vehicle, in many cases we will need to lower the rear exhaust system in order to gain access to fit the towbar, we will not be liable to replace exhaust parts where damage has occurred due to pre-existing corrosion of the exhaust system.

This also applies to the bumper of your vehicle, in order to fit some towbars a bumper cut is required. If you do not wish for your bumper to be cut you will need to speak to us prior to booking your fitting to see if other options are available.

We are unable to install a towbar on corroded metal, it is your responsibility to ensure your vehicle is in a fit condition to have a towbar fitted. If it becomes apparent during the fitting your vehicle is not in a fit condition, the fitting will be stopped and you will be liable for costs incurred by us plus the standard call out fee. The standard call out fee is £125 + VAT = £150.  

 

  1. Cancellation of Work

You have the right to cancel your order within 14 days from the point of “acceptance”. However, where you ask us to commence your order within this period you agree to waive the right of cancellation.

Where no costs have been incurred there will be no charge. Where costs have been incurred, for example when parts have been ordered, you will be issued a refund minus the costs incurred.

If you cancel or rearrange your fitting appointment with less than three full working days’ notice you will be charged for incurred costs and the standard call out fee.

If the vehicle is not available at the time of your fitting appointment, or we are unable to carry out the fitting due to circumstances within your control, or if there are any undeclared modifications that prevent the installation, you will be charged the standard call out fee and incurred costs.

 

  1. Our Liability to You

Upon completion of the installation, the technicians will test the towing electrics with their testing equipment, if you wish to be shown the lights working on their equipment you will need to ask the technicians at the start of the appointment. It is still your responsibility to test your towbar and electrics before towing.

We offer a 12-month warranty on towbar installations; any problems will be delt with by us within this period subject to the correct usage of goods at the original fitting address. If upon the technicians arrival it is evident that the damage or problem are due to an external reason; this includes but is not limited to incorrect usage, negligence or fault with a towed item, then you will be charged the standard call out fee.  

If you believe your towbar installation is faulty or unsatisfactory, you must contact us in the first instance and we are happy to attend under your warranty. Ultimate Towbars will not be responsible for any third-party expenses incurred unless agreed upon by ourselves.

Ultimate Towbars will not be liable for any economic losses arising in any manner whatsoever out of any delays to, or complications with the fulfilment of your order. This includes any losses incurred from missed holidays, or caravan site deposits etc. Under no circumstances should you arrange to use your towbar until after the installation has been completed and you have fully tested the towbar and electrics.

 

  1. Data Protection

Your data is protected and only used by Ultimate Towbars to process information that is relevant to your quote and fitting appointment where an order has been accepted. Ultimate Towbars are registered and regulated by the Information Commissioner’s Office.

 None of these terms and conditions alter or effect your statutory rights under the Consumer Rights Act 2015. 

Ultimate Towbars is the Trading name of Ultimate Towbar Systems Limited.
